Where multiple causes of action arise from a single series of events on one occasion, a trial judge does not err in ordering the unsuccessful defendant to pay the successful plaintiff's full costs even where the plaintiff succeeded on only one of several causes of action. Section 60 of the Civil Procedure Act 2005 (NSW) concerns procedural proportionality and does not govern the exercise of the costs discretion under s 98 and r 42.1.
