Wholly concurrent sentences for multiple break, enter and steal offences committed over an extended period, particularly where some offences were committed on parole, are contrary to the Pearce principles and will be set aside on Crown appeal. The standard non-parole period for s 112(2) offences must be addressed in sentencing remarks even after a guilty plea, and reasons must be given for any departure under s 54B. Protective custody cannot be treated as a mitigating factor without evidence of its practical impact on the offender.
