Where a sentencing judge finds special circumstances and states an intention to reduce the non-parole period to 50 per cent of the head sentence, partial accumulation of sentences that results in an aggregate non-parole period of approximately 83 per cent of the overall term fails to give effect to that finding and warrants appellate intervention. Defence counsel's calculated decision at trial not to seek remedial directions regarding a Crown address may preclude reliance on that ground on appeal.
