A Crown Prosecutor who publicly expresses an opinion as to the guilt of an accused person, or publicly comments on the correctness of court determinations in a pending matter, breaches Bar Rule 59 and the Prosecution Guidelines and may be prevented from prosecuting the trial. The test is whether a fair-minded, reasonably informed member of the public would conclude that the proper administration of justice requires that the prosecutor be prevented from appearing. The trial judge's ability to manage the trial through jury directions does not answer the question of whether the trial would be seen to be fair.
