Telephone intercept evidence of a co-accused's self-incriminatory statements is not admissible against another party to the call merely to show 'close association' or 'deep interest' where the other party did not adopt the incriminatory statements. A Murray direction warning the jury to scrutinise the evidence of a single witness with great care is not mandatory in all sexual assault cases, particularly where the Crown case does not depend solely on the complainant's testimony. Where the Crown has not asserted consciousness of guilt in relation to a particular accused's lies, and the jury is directed not to consider consciousness of guilt for that accused, no Edwards direction is required.
