When assessing total and permanent disablement under a group life policy requiring six months' absence from employment, the assessment is made as at the expiry of the six-month period. Employment for which the member became qualified only by subsequent retraining is irrelevant to that assessment and constitutes an irrelevant consideration if taken into account by the insurer. Where a trust deed definition of disablement differs from the insurance policy definition, the trustee must apply the trust deed definition; failure to do so renders the trustee's decision void for addressing the wrong question.
