Under clause 36 of AS4300-1995, the principal's liability for delay or disruption costs is limited to the delay for which extensions of time have been granted under clause 35.5(b)(i); it is not sufficient that any extension of time has been granted for delay caused by the principal. Section 27 of the Building and Construction Industry Payments Act 2004 (Qld) applies only to the valuation of construction work and does not prevent a later adjudicator from reconsidering deductions for liquidated damages. The court also indicated in obiter that damages calculated by the Hudson formula (loss of overheads and profit) may not constitute 'costs' within the meaning of clause 36.
