An adjudicator who misinterprets a construction contract commits an error within jurisdiction that is not reviewable, but an adjudicator who awards payment on a basis outside the contract commits a jurisdictional error rendering the decision void. Where an adjudicator proposes to decide a claim on a basis not advanced by either party, the adjudicator must afford the parties an opportunity to make submissions on that point under s 25(4) of the BCIPA, and failure to do so constitutes a denial of natural justice invalidating the decision.
