The rehabilitation of youthful offenders need not be given primacy as a sentencing consideration where the circumstances of the offences are very serious, the offender has a significant prior criminal history demonstrating failure to take advantage of prior rehabilitation opportunities, and the evidence of rehabilitation prospects is weak. The three general propositions concerning youthful offenders stated in R v Mills cannot be applied in every case.
