Where a sentencing judge purports to take a forfeiture order into account but does so only after the sentence has already been determined, and does not explain why the sentence remains unchanged, this constitutes a specific sentencing error requiring re-sentencing. For addicted street-level heroin dealers aged in their late teens to mid-twenties, sentences in the range of five to six years' imprisonment are appropriate for trafficking in commercial or large commercial quantities, having regard to youth, addiction, admissions, guilty pleas, and rehabilitation prospects.
