Evidence of uncharged acts is not per se excluded from cross-admissibility between complainants in multi-complainant sexual offence trials; the same principles governing cross-admissibility of charged acts apply. The collateral evidence/finality rule is a flexible case management rule, and evidence going to credibility that possesses real probative value with respect to facts in issue should generally be admitted even if it falls outside the established exceptions, particularly where the credibility of the witness is fundamental to conviction.
