In criminal trials, an informal concession made by defence counsel in opening address is not a formal admission pursuant to statute and may be withdrawn. The fundamental right of the defence to put the prosecution to its proof will generally constitute a sufficient reason for withdrawal, and case management considerations cannot override this right. Where evidence across multiple counts is closely intertwined, an error affecting one count may infect convictions on all counts, including those of co-accused tried jointly.
