The correct approach under s 76(2) of the Sentencing Act 1995 (WA) requires a sentencing judge to first consider whether imprisonment is appropriate, then consider whether the term should be suspended having regard to all relevant factors including personal circumstances, and then fix the term. A sentencing judge need not expressly mention every available sentencing option provided proper principles are observed. For unprovoked serious assaults with dangerous weapons causing severe injury, immediate imprisonment may be the only sentence reflecting general deterrence even where the offender has impeccable antecedents.
