In cases of aggravated armed robbery where the offender personally uses a weapon causing bodily harm, a sentence of immediate imprisonment is generally the only appropriate disposition, and good antecedents and lack of prior convictions will not ordinarily justify a suspended sentence. A trial judge's direction on party liability under s 7 of the Criminal Code (WA) need only deal with so much of the law as is necessary to assist the jury, and in a simple case where the only issue is whether the accused was a participant or a bystander, a direction need not elaborate on the concept of active participation if the direction as a whole makes the issue clear.
