Clause 7(3) of Sch 1 to the Criminal Procedure Act 2004 (WA) is to be given a relatively wide reach, consistent with the general trend of authority that joinder provisions should not be given an unduly restrictive meaning. For joinder of offences against different persons, one or more limbs of cl 7(3) must apply to all offences charged. Drug offences involving the same type of drug, occurring on the same night, and originating from the same stockpile satisfy both cl 7(3)(a) (series of similar character) and cl 7(3)(b) (closely related acts).
