The parity principle does not require identical sentences for co-offenders where there are significant differences in culpability, criminal history, age, rehabilitation prospects, and the existence of Form 1 matters. Inconsistent findings of fact between co-offender sentencing proceedings do not of themselves establish error. The extent to which parity applies where co-offenders are sentenced for different offences remains open to debate.
