In sentencing for murder, an intention to kill alone cannot establish that the offence is above the midrange of objective seriousness for the purposes of the standard non-parole period; all relevant circumstances of the offence must be considered. Using the standard non-parole period as a starting point rather than a reference point remains an error of principle.
