Breach of conditional liberty (being on bail or bond) must not be included as a factor in the assessment of objective gravity for the purposes of the standard non-parole period; it is a separate aggravating factor to be considered after objective gravity is assessed. Sentencing judges must make specific findings as to where an offence falls relative to the mid-range of objective gravity and cannot leave the assessment indeterminate. A non-parole period of half the standard non-parole period for an offence at or above the mid-range of objective gravity strongly indicates the standard non-parole period has impermissibly disappeared from the sentencing exercise.
