The word 'mutilates' in s 45(1)(a) of the Crimes Act 1900 (NSW) requires proof of lasting damage, destruction or disfigurement to the clitoris; a nick or cut that heals without lasting effect does not constitute 'mutilation'. The 'clitoris' for the purposes of s 45(1)(a) refers to the entire clitoral organ, not merely the external or visible part. Expert evidence in FGM prosecutions must satisfy the requirements of s 79 of the Evidence Act and opinions not derived from specialised knowledge are inadmissible.
