The R v Henry guideline judgment for armed robbery offences under s 97(1) of the Crimes Act 1900 is not confined to completed armed robberies; an assault with intent to rob involving significant actual violence may be at least as serious as the offences contemplated in the guideline. Delay in the trial process and bail conditions do not justify significant mitigation where the offender has not demonstrated progress towards rehabilitation and the crimes are not stale. A sentencing judge cannot find that imprisonment would be more arduous for offenders in their early forties without evidence to support that finding.
