Where offences subject to standard non-parole periods are imposed, the sentencing judge has no discretion under s 45(1) of the Crimes (Sentencing Procedure) Act 1999 to decline to set a non-parole period; fixed terms cannot be imposed for such offences. In multi-victim cases, prosecutors should structure Form 1 documents with a separate Form 1 for each victim to avoid double counting. Parity requires that real differences in culpability between co-offenders — including differences in criminal history, risk of reoffending, and the subordinate role of one offender — be reflected in different sentences.
