The absence of an intention to kill and the absence of premeditation do not, of themselves, dictate that the objective seriousness of a murder falls below the mid-range for the purposes of the standard non-parole period. Strangulation is a particularly horrible way to die and may support a finding of mid-range seriousness even without premeditation or an intention to kill.
