A cross-claim arising from transactions entirely distinct from the plaintiff's claim cannot constitute an equitable set-off, even where the alleged misconduct may have contributed in a general way to the defendant's inability to pay the debt. The mere rendering of payment more difficult does not establish the necessary nexus. Where the absence of sufficient connection is manifest on the pleadings and evidence, summary judgment should not be refused on the basis that factual investigation is needed.
