Merely asking household members whether they were driving, without being able to identify the driver or demonstrating any system of control over vehicle use, is insufficient to satisfy the defence under s 114(3) and (6) of the TORUM. The inability to identify the driver is itself suggestive of the absence of reasonable control and the absence of a reasonable system for ascertaining the driver's identity.
