A deemed refusal of a parole application under s 193(5) of the Corrective Services Act 2006 (Qld) is amenable to judicial review under the JRA, but the correct basis for review is s 20(2)(e) and s 23(g) (unreasonableness) or s 20(2)(b) (failure to observe required procedures), not s 22 (failure to make a decision), because the deeming provision creates a decision as a matter of law. A parole board cannot produce an unchallengeable deemed refusal by the simple expedient of not considering an application at all.
