An applicant for a stay of a striking-off order must demonstrate more than the inevitable prejudice suffered by any practitioner struck off; the additional factors must outweigh the public interest in having unfit practitioners debarred. The prima facie rule in private litigation that a stay will normally be granted where the appeal would be rendered nugatory does not apply in disciplinary proceedings. Extensive undertakings including not personally undertaking legal work, independent supervision, and client notification may suffice to mitigate the public interest concerns and justify a stay where the appeal is arguable and imminent.
