Service of an application to set aside a statutory demand under s 459G of the Corporations Act 2001 (Cth) is valid where documents are left at the address nominated for service in the statutory demand, being the last known address of the respondent's residence or business, without personal service being required. General Counsel of a large corporation has implied authority to instruct external solicitors to apply to set aside a statutory demand without a board resolution. Signing originating applications in the name of the solicitors' firm rather than an individual solicitor's name is valid or at most a curable irregularity under r 371 UCPR.
