A plaintiff alleging misuse of confidential information must identify the specific information with precision in its pleadings; ambit claims and mere comparison of similarities between processes are insufficient. The burden remains on the plaintiff to prove both that the information is confidential and that it was misused. An experienced former employee who is not subject to a restraint of trade clause is free to use general skill and knowledge acquired during employment, even where that knowledge substantially overlaps with the employer's processes.
