A sentence of 12 months' imprisonment for deliberate importation of a marketable quantity of pseudoephedrine is manifestly inadequate. Mercy shown to a co-accused due to terminal illness does not give rise to a parity argument for co-offenders. The Court retains an overriding discretion to decline to re-sentence even where manifest inadequacy is established, particularly where the combined effect of double jeopardy and the respondent's release from custody makes re-sentencing inappropriate.
