A sentence which does not require an offender to serve an immediate custodial term for intentionally causing serious injury is not necessarily manifestly inadequate. Where the term of imprisonment is not outside the range, the Director will ordinarily face substantial difficulty in establishing manifest inadequacy by reason of the decision to make an intensive correction order. The fact that an offender did not intend the catastrophic consequences of an assault has a significant bearing on the assessment of sentence adequacy. The principle of double jeopardy has particular application where a sentence has already been partly served in the community.
