For a conviction of cultivating a narcotic plant in not less than a commercial quantity, the jury must draw the ultimate inference of intention to cultivate at least the threshold quantity. A direction that the accused need only have 'believed or was aware that there was a significant or real chance' that the amount was not less than a commercial quantity is insufficient. Awareness of a significant chance is relevant to, but not a substitute for, the finding of intention.
