Where an offender's parole is cancelled after sentencing for offences committed while on parole, the Court of Appeal will apply the totality principle to the aggregate of the sentence imposed and the cancelled parole term, but will do so in a manner that does not undermine the legislative policy of cumulation in s 16(3B) of the Sentencing Act 1991 (Vic). The fact that parole has been cancelled and added to the sentence does not of itself require the Court to intervene.
