Where parole is cancelled after sentence, the sentencing discretion is reopened and the totality principle requires the court to consider the aggregate of the new sentence and the remaining parole sentence. However, the statutory presumption of cumulation under s 16(3B) must be preserved absent exceptional circumstances, and the appropriate mechanism for moderating the aggregate sentence is reduction of the head sentence rather than ordering concurrency. Neither party identifying exceptional circumstances means the presumption of cumulation applies.
