Clause 2(1) of Schedule 1 to the Sentencing Legislation Amendment and Repeal Act 2003 (WA) applies to all offences, including those created after the transitional provisions commenced on 31 August 2003. Courts sentencing for such offences must reduce the sentence by one-third. The majority decision in Wallam is overruled on this point. The 'old provisions' in cl 2(1) refer to a legislative sentencing scheme, not to offences as such.
