Delay between the commission of an offence and sentencing is not a mitigating factor where the delay resulted from the offender's success in avoiding detection and a late guilty plea, rather than from unfairness to the offender. A psychiatric condition mitigates sentence only where a causal connection is established between the condition and the commission of the offence reducing moral culpability; absent such a connection, the condition may still warrant a discount if it makes imprisonment more onerous.
