The voidness or unenforceability of an underlying agreement cannot vitiate the effectiveness of a deed of assignment that is clear on its face. Where an assignee is estopped from denying that she took an assignment as trustee, the products of the assignment (including proceeds of sale and royalties) are held on trust proportionately. A party cannot raise on appeal a case directly contrary to the case run at trial, particularly where it might have led to different evidence.
