A solicitor's alleged failure to advise from the inception of a retainer is too far removed from the actual conduct of a trial to be covered by advocate's immunity where the retainer extends over a long period before trial. Where a client who is a former solicitor exercises control over the conduct of proceedings and instructs the solicitor on the claims to be made, the client's control is relevant to both the question of negligence and the question of whether the client would have accepted different advice (causation).
