A person who constructs stairs or other structures on land they have permission to use, and who invites others to use those structures for the purposes of their business, has a sufficient degree of possession or control to be classified as an occupier vis-à-vis those invitees, even if the person does not consider themselves responsible for the structures. A roads authority cannot discharge its duty of care to ensure safe passage on a public road merely by forwarding a safety audit report to a third party without taking further steps to ensure the identified risks are addressed. A plaintiff who lets go of a handrail and charges forward in darkness on stairs, knowing visibility is inadequate, is contributorily negligent even though the defendants' breach created the dangerous situation.
