Where an architect's engagement during the construction phase is limited to selection of finishes and colours, the delivery of tile samples for the client's approval does not constitute a representation that the tiles comply with the technical requirements of the specification, and does not give rise to a duty of care in respect of technical compliance. The building contract's allocation of responsibility for technical compliance to the builder is relevant to determining the scope of the architect's duty.
