An application for interest on costs under s 101(4) of the Civil Procedure Act 2005 (NSW) must be made at the time of the costs order or within 14 days thereafter under UCPR 36.16. The effective costs judgment is the court's costs order, not the costs assessor's certificate when filed. First instance decisions permitting applications for interest on costs at any time before registration of the costs assessor's certificate (such as Lucantonio v Kleinert) are incorrect.
