Factors that are inherent in the R v Henry guideline characteristics for armed robbery (limited planning, limited violence, small amount taken) cannot be relied upon a second time to reduce offences below the guideline range. Bail conditions of approximately 11 months with daily reporting and non-association conditions do not warrant departure from the Henry guidelines; only extremely onerous conditions such as house arrest or de facto home detention, or conditions maintained for an unusually long time, attract favourable consideration. The absence of drug addiction is not a mitigating factor for the objective seriousness of armed robbery.
