It is not appropriate for a court to adopt a mathematical formula to convert time spent in protective custody to an equivalent period in the general prison population. Where protective custody is voluntarily sought, the sentencing court is entitled to scrutinise its significance and give it little weight where the basis is vague. Injuries inflicted by a victim during the commission of an offence do not automatically constitute extra-curial punishment requiring a sentencing discount; the court may consider whether the victim's response was proportionate to the threat posed.
