A court cannot impose a fixed term of imprisonment without a non-parole period for an offence listed in the Table to Div 1A of Pt 4 of the Crimes (Sentencing Procedure) Act 1999 (NSW); s 45(1) mandates that a non-parole period be set for such offences. Irregularity in the sentencing process regarding the standard non-parole period does not require intervention where no lesser sentence is warranted. Parity arguments are difficult to sustain by reference to global sentences where a co-offender was also sentenced for unrelated matters.
