Where a sentencing judge finds that a co-offender played a greater and more dominant role in the offending and that the offender was influenced and pressured by the co-offender in a relationship characterised by domestic violence, the lack of disparity between their sentences bespeaks error. Financial gain cannot be treated as an aggravating factor under s 21A(2)(o) for an offence under s 25A of the Drug Misuse and Trafficking Act 1985 where financial reward is an element of that offence. The aggravating factor of planned or organised criminal activity under s 21A(2)(n) cannot be applied where no planning or organisation is established beyond what is inherent in the offence of ongoing drug supply.
