The guideline judgment in R v Thomson & Houlton on guilty plea discounts does not create a minimum discount; a discount of approximately 10% for a plea entered on the day of trial is within the sentencing judge's discretion. When sentencing with a Form 1 offence, the sentence must reflect the totality of criminality, and it is wrong to compare a sentence directly with that of a non-co-offender simply because the offenders have similar characteristics.
