A sentence of nine months imprisonment with release after four months (44% of head sentence) was upheld for seven bomb hoax calls under s 474.16 of the Criminal Code (Cth) involving the evacuation of approximately 200 patrons. There is no rigid rule as to the proportion of a Commonwealth sentence to be served before recognizance release, except in drug cases. The proportion is to be fixed by taking into account all circumstances rather than by arithmetical rule of thumb.
