The Pointe Gourde principle in reverse applies to the assessment of compensation under s 20(2) of the Acquisition of Land Act 1967 (Qld) even where a separate right to claim compensation for injurious affection exists under planning legislation, because the injurious affection claim is subsumed by the compulsory acquisition claim under the relevant Queensland statutes. However, where compensation for injurious affection has already been paid prior to compulsory acquisition, the Pointe Gourde principle in reverse does not apply.
