There is no significant difference for sentencing purposes between driving contrary to an administrative licence suspension by the Road Transport Authority and driving contrary to a court-imposed disqualification, as both derive from the same legislatively mandated regime. Periodic detention is a lenient form of imprisonment and should not be imposed for a longer period than would have been imposed if full-time imprisonment had been ordered. A sentence to the 'rising of the court' is within power in the ACT under s 63(3) of the Crimes (Sentencing) Act 2005 (ACT), but the court should specify when it rises.
