A sentencing judge must first fix the appropriate term of imprisonment and only then consider whether to order it be served by way of periodic detention; it is impermissible to decide on periodic detention first and then fix the term at the maximum available under that regime. The Court of Criminal Appeal retains jurisdiction to hear an appeal against the original sentence notwithstanding revocation of the periodic detention order by the Parole Board.
