Section 425 of the Migration Act does not require the Tribunal to press an applicant to call further evidence on psychological impairment or to seek out such evidence itself; a hearing is not nullified merely because the applicant might have presented a more compelling case if better advised. The factual findings of an administrative tribunal contained in its reasons are 'previous representations' subject to the hearsay rule in s 59(1) of the Evidence Act 1995 (Cth), but once admitted for the non-hearsay purpose of proving the Tribunal's reasons, s 60(1) renders them admissible to prove the truth of those findings unless a limiting order is made under s 136.
